Megan Thee Stallion Sexual Harassment Lawsuit Dismissal Denied

A federal judge has ruled that a sexual harassment and retaliation lawsuit filed against Megan Thee Stallion by her former cameraman, Emelio Garcia, can proceed through litigation.

On Wednesday (July 2), U.S. District Judge Gregory H. Woods concluded that Garcia has presented enough evidence to support claims that he endured a hostile work environment, allegedly tied to his sexual orientation.

Garcia, who is openly gay, alleges that while working with Megan—born Megan Pete—he was subjected to repeated mistreatment. This includes an incident in Ibiza in 2022 where the rapper allegedly engaged in a sex act with another woman in his presence.

The lawsuit, which was filed in April 2024, also claims she attempted to assault him with a remote and made demeaning comments about his physical appearance.

According to Garcia, these actions were intentionally directed at him because of his sexuality. Judge Woods noted in his ruling that Garcia “plausibly pleads that the alleged sexual encounter in the SUV in Ibiza created a hostile work environment based on plaintiff’s sexual orientation.”

The judge elaborated on Garcia’s assertion that “Pete would not have engaged in group sex with other women in front of a heterosexual male; that Pete felt comfortable engaging in group sex with other women in front of plaintiff because of plaintiff’s sexuality and gender.”

Judge Woods concluded, “This is not an unreasonable inference to draw from the facts alleged. Therefore, plaintiff has plausibly pleaded that he experienced the alleged inferior conditions of his employment on account of his sexual orientation.”

Garcia also claims that after raising concerns about the incident, he was met with retaliatory actions by Megan and her team, including cuts to his hours and pay, and ultimately, termination. He alleges he was also “blackballed” from future industry work.

Judge Woods found that “these facts raise a reasonable inference that material terms and conditions of plaintiff’s employment were altered in retaliation for speaking up about the Ibiza incident.”

Megan Thee Stallion and her representatives have forcefully denied the accusations, branding Garcia a “con artist,” and claiming his lawsuit is “entirely of falsehoods, misrepresentations of fact, and outlandish claims that have no basis in fact or law and no merit.”

If Megan Thee Stallion, Roc Nation, and Garcia cannot come to a settlement, the case will ultimately go to trial.
